OS54 of 2021/Agreement of Sale
Agreement of Sale by Jaihind Reddy (2013)
On 13-03-2013, Mr. Jaihind Reddy entered into an Agreement of Sale for Ac.146.05 guntas with 10 pattadars, covering 13 survey numbers.
Based on this agreement, he later filed OS No.54 of 2021 against the said pattadars and obtained a Collusive decree on 14-09-2021 for execution of a registered sale deed. An Execution Petition (EP No.323) was subsequently filed which was not executed. As a result, the decree remains unimplemented.
Subsequent Sales by Pattadars
The same Pattadars executed registered sale deeds for the very same Ac.146.05 guntas in favour of multiple entities, including Sreenidhi Luxury Villas LLP, Top-Notch Builders Pvt. Ltd., Equidistant Infrastructure Pvt. Ltd., Creative Developers & Real Estate, R&R Realtors, and several other individuals and companies.
Suits Filed by Jaihind Reddy (2023)
Challenging these subsequent registrations, Jaihind Reddy filed 12 civil suits against the pattadars (as executants) and the later purchasers (as claimants), seeking cancellation of sale deeds registered through Dharani.
The suit numbers are:
OS Nos. 394, 400, 401, 412, 413, 419, 420, 421, 463, 712, 713 & 714 of 2023.
Prior Rights of Shankar Hills Plot Owners:
It is important to note that individual plot owners of Shankar Hills had already purchased plots in 33 survey numbers, including the above 13 survey numbers, during the period 1983–1986.
Therefore, all transactions made in 2013, 2021, and thereafter relate to land that was already sold decades earlier, and neither Jaihind Reddy nor the subsequent purchasers had valid or subsisting rights over the said land.
Society’s Legal Action
In view of the above facts, the Shankar Hills Mutually Aided Cooperative Society has impleaded itself in all the above 12 suits, seeking dismissal of the cases, as the subject land was already lawfully purchased by plot owners long prior to these later transactions.
Why claims of Jaihind Greenfields,Sreenidhi Luxury Villas LLP,Top-Notch Builders,Equidistant Inftrastructure and Other Dharani Claimants cannot override plot owners’ rights
Shankar Hills is a duly approved plotted layout, where land was legally converted into individual plots and sold to purchasers through registered sale deeds. Once the land was approved, subdivided, and conveyed as plots, the original Pattadars no longer retained the authority to treat or transact the land as a single agricultural holding.
Despite this, decades later:
Pattadars entered into an Agreement of Sale with Mr. Jaihind Reddy for large extents of land that were already sold as plots
Plot owners were not parties to this agreement
The agreement was executed without possession, without title, and without authority

👉 How can land already sold, plotted, approved, and occupied be claimed again as vacant agricultural land?
OS 360/1996 & AS 369/2005
Shankar Hills Plot Purchasers Welfare Association (SHPPWA), with registration number 2210/1989, was established by Mr. P. Yellamanda. The association filed OS 360/1996 for a perpetual injunction against Pattadars and GPA holders, who were attempting to resell already sold-out plots.
The claim was dismissed on 9 March 2005 on technical grounds. Aggrieved by the decision, Mr. Yellamanda appealed in AS 369/2005 before the Hon’ble High Court of the undivided State of Andhra Pradesh, which is still pending.
OS 60/2001
Service Links International Limited filed OS 60/2001 against Karunakar Chowdary, Pattadars, GPA holder N. Rangareddy, Yellamanda, Shankar Hills Association, and Jai Hind Green Field Private Limited. The suit was dismissed on 29 April 2008.
D5/3214/2001 – Association Representation to Collector
Shankar Hills Association filed a representation in D5/3214/2001 to the Joint Collector. An order by the Collector, passed on 6 January 2004, indicated that Pattadars had executed two GPAs and sold the plots. The MRO was directed to mutate the name of Shankar Hills. The Darugupalli family filed WP 3123/2004 in the High Court against this order. The mutation was canceled as it applied only to agricultural land.
OS 907/2006, AS 338/2013 & OS 165/2011
Shankar Hills Association filed OS 907/2006 for a perpetual injunction against Pattadars and others. After the court’s rejection of OS 907/2006, citing that the Association doesn’t own the land, AS 338/2013 was filed in the High Court. The appeal was allowed, leading to the association’s amendment to include 1400 plot owners in OS 907/2006. Consequently, the court granted a perpetual injunction.
The appeal was withdrawn following a compromise in OS 165/2011 with some Pattadars.
OS 165/2011
Eleven Pattadars filed OS 165/2011 for a perpetual injunction against the association. During this period, the association entered into an agreement with Sai Krishna Developers to resolve litigations. Sai Krishna Developers settled with the Pattadars, paying 13.60 crore rupees.
B/1100/2017 – To Update Revenue Records
Based on the OS 165/2011 compromise and B/1100/2017 proceedings, Shankar Hills Association received an order to update the revenue records under the Revenue’s Land Records Updation Program.
The land in all 33 survey numbers was included in revenue land records as sold land. However, buyers in Acres filed approximately 16 writ petitions against these orders, which were dismissed as the revenue records were updated without notifying existing Pattadars. Later, Dharani records listed Pattadars as the owners of the already sold land.
OS 525/2021
In OS 525/2021, a compromise was reached with four Pattadars of the Darugpalli family involving 100 plot owners.
12 Cases Filed by Jaihind Reddy: Jaihind Reddy filed 12 suits (OS 394/2023, OS 400/2023, OS 401/2023, OS 412/2023, OS 413/2023, OS 419/2023, OS 420/2023, OS 421/2023, OS 463/2023, OS 712/2023, OS 713/2023, OS 714/2023) totalling 146 acres, related to documents sold by Pattadars after Dharani’s introduction.
All major companies like Sreenidhi Luxury villas LLP, Equidistant infrastructure Pvt Ltd, Top-notch builders Pvt Ltd, etc., are involved in such dubious transactions with Pattadars via Dharani and are parties/defendants in these cases for the cancellation of sale deeds. This is nothing but an unethical transaction between the pattadars and dubious purchasers. That is why the Society has impleaded in all the above cases to assert the rights of its members.
7 Cases by pattadars
7 Cases related to family partition claims (OS 122/2021, OS 310/2022, OS 324/2022, OS 300/2022, OS 307/2022, OS 317/2022, OS 539/2022), and OS 54/2021 decree of 146 acres for which Jai Hind Reddy entered into an agreement of sale bought with 10 pattadars.
EP 323/2022 In OS 54 of 2021:
Jaihind Reddy filed an execution petition for non-compliance of the decree of OS 54 of 2021 by the 10 pattadars to register the subject land of agreement of sale. The point to be noted here is that the pattadars have already re-sold almost all the subject land in Dharani after the OS 54 of 2021 decree and have no land in their possession to register in favour of Jai Hind Reddy.
OS 511/2021:
Specific performance suit by LVSR Farms Pvt Ltd against R. Mutyam Reddy & others for violating a sale agreement.
OS 1278/2013:
Suit for perpetual injunction against Shankar Hills Association by Lingareddy Sunitha, Sunil, Subhash for 9 acres.
OS 1480/2007:
Suit for perpetual injunction against 80 owners by Kalidindi Manjulata Devi for 2 acres.
OS 731/2007:
Perpetual injunction suit against Shankar Hills Association by Kalidindi Manjulata Devi for 2 acres.
